RULES AND PROCEDURES GOVERNING THE myLOTTERY 2026 GEMSTONE SMASH PROMOTION

The State Lottery Commission of Indiana (“Lottery” or “Hoosier Lottery”), hereby promulgates these rules and procedures (“Official Rules”) governing the myLOTTERY 2026 Gemstone Smash Promotion (“Promotion”).

A. PURPOSE

The Promotion will be held to generate awareness of the Hoosier Lottery February Scratch-off games and increase myLOTTERY membership and engagement.

B. PROMOTION PERIOD

1. The Promotion period will begin on or about 12:00 AM (ET) on Tuesday, February 3, 2026, and the Promotion entry deadline will be at 11:59 PM (ET) on Monday, April 27, 2026.  

C. PROMOTION & PRIZE DESCRIPTIONS

1. The Promotion will be conducted in accordance with all applicable statutes, regulations, and rules for the listed Prizes:

D. ELIGIBILITY

1. This Promotion is open to legal residents of Indiana who are eighteen (18) years of age or older at the time of entry.
2. State Lottery Commission of Indiana members, officers, and employees, and any relative(s) (spouse, parents, siblings and children) and/or person(s) residing in the same household of such Hoosier Lottery member, officer, or employee are not eligible to participate in this Promotion. This restriction applies mutatis mutandis to the Lottery’s Integrated Service Provider, Brightstar Lottery Indiana, LLC, (“Brightstar”). 
3. Members, directors, officers, or employees of a major procurement vendor of the Hoosier Lottery, and/or Brightstar, and any relative(s) (spouse, parents, siblings and children) and/or person(s) residing in the same household of such persons are not eligible to participate in this Promotion.
4. No purchase necessary. Void where prohibited.

E. HOW TO PARTICIPATE  

Gemstone Smash is accessible on the Hoosier Lottery website exclusively for myLOTTERY members.

To enter Promotion:

1. Visit HoosierLottery.com/ComeOutToPlay during the Promotion Period and create or log into myLOTTERY account. Players may also be prompted to play through the Hoosier Lottery app and directed to HoosierLottery.com/ComeOutToPlay.
   1. Upon starting gameplay of a weekly Gemstone Smash challenge, players will automatically be entered into the Promotion.
      1. Successful completion and score of Gemstone Smash games does not affect a player’s entry or likelihood of winning a prize in the Promotion. 
      2. Players can participate each week (Tuesday – Monday) and can earn up to one (1) entry per week.
      3. Upon exiting or finishing the Gemstone Smash, a message will be displayed to notify the player of a completed entry into the Promotion. The message is only evidence that an entry has been received and does not indicate that the entry is valid.
      4. Players can play multiple times each week, but will only receive one entry per week (Tuesday – Monday).
2. Entrants must have a current myLOTTERY account in good standing to enter this Promotion. 
3. If an entrant does not have a myLOTTERY account, the entrant can sign up for a free account by selecting “CREATE AN ACCOUNT” on the Promotion’s web page or at www.HoosierLottery.com/mylottery to register and complete the myLOTTERY account sign up. 
4. Once the entrant confirms their account on the Promotion’s web page, entrants must provide their name, email address, phone number, and date of birth. Entrant’s name must match the name on his/her government-issued ID. 
5. An automated message will notify the entrant of a completed entry into the Promotion. The message is only evidence that an entry has been received and does not indicate that the entry is valid.
6. All entries submitted in the manner as described in these Official Rules will be eligible for an entry in this Promotion. Hand delivered or mailed in entries will not be accepted for this Promotion and will be deemed invalid and destroyed.

F. ODDS OF WINNING 

The odds of winning a prize are dependent upon the total number of entrants.

G. DRAWING, WINNER NOTIFICATION AND CLAIMING OF PRIZE

1. The winners as well as alternates of this Promotion will be selected from all eligible entries received by using a random number generator from random.org under the supervision of a member of the Lottery Security team. 
2. Five (5) winners and five (5) alternates will be drawn on the draw date designated in Section C.1. 
3. Entries selected as winners for this Promotion will be notified in writing via email and/or phone number with the information provided with the entrant’s contact information. Winner must claim prize within five (5) business days. After five (5) business days, the prize may be offered to an alternate. If all alternates are exhausted, the prize(s) shall be forfeited.
4. Each drawn winner can win only once per Promotion.
5. Upon timely presentation of winner’s government-issued ID, the entry will be validated, and eligibility will be verified as in Section D (“Eligibility”).
6. Once verification and authorization of the winner are complete, Prize will be provided to the winner. 
7. Prize may be claimed by mail, but the winner must have an Indiana address.

H. GENERAL RULES AND PROVISIONS

1. The rules and procedures set forth in these Official Rules shall govern this Promotion. These rules may be amended at any time by the Lottery without advance notice. 
2. The Lottery’s Executive Director or her designee may, at any time, announce a suspension or termination of the Promotion, without advance notice and in the Executive Director’s sole discretion, at which point no Prize shall be awarded. None of the Lottery, the Executive Director, Brightstar, or any employee thereof, shall have any liability whatsoever for any such termination.
3. By participating in the Promotion each person agrees to comply with and abide by Indiana law, rules, and regulations as well as the terms and conditions of the Lottery website and all final decisions, policies, or procedures of the Lottery in relation to the conduct of this Promotion. Any dispute arising which relates to any aspect of this Promotion shall be governed by the laws of Indiana. 
4. In the event of a dispute arising out of these Official Rules, the player’s remedy is limited to entry in another promotion with prizes of a similar value.
5. The Lottery, Brightstar, and their agents are not responsible for error, omission, interruption, deletion, defect, delay in operations, theft or destruction, unauthorized access to or alterations of the Promotion, failure to receive claim, winner, or other Promotion information for any reason whatsoever.
6. Except where prohibited by law, in consideration for being permitted to participate in this Promotion and the opportunity to win the prizes offered in this Promotion, each entrant hereby agrees and consents, without further authorization, compensation or remuneration of any kind, to the use of the entrant’s name, likeness, voice, photograph, performance, personal statements and/or biographical information in any and all advertising, promotions and other publicity conducted by Lottery, and Brightstar. 
7. The Lottery is not responsible for issues with account accessibility or Promotion entries due to technical problems associated to software, hardware compatibility or internet access. 
8. By entering this Promotion, each entrant agrees to follow these Official Rules and forever releases, discharges, and waives any and all claims, liabilities and actions of any kind, howsoever caused or arising and whether by negligence, any intentional act or otherwise, that entrant may have or that may arise against the Lottery, Brightstar, and each of their respective parents, subsidiaries, affiliates, and related entities, as well as each of the aforementioned parties’ respective associates, directors, officers, owners, shareholders, partners, members, employees, agents, representatives, successors and assigns (collectively, the “Released Parties”), with respect to or arising directly or indirectly, out of, or in any way connected with, (i) entrant’s participation in this Promotion; or (ii) the receipt or use of the prizes (including but not limited to the substitution or changing of any prizes) awarded in this Promotion. By entering, each entrant further agrees to defend, indemnify and hold harmless the Released Parties and their insurers against any and all damages, costs, judgments, and/or expenses (including but not limited to attorneys’ fees and/or other legal fees) they may incur as a result of claims made against them in connection with either (i) entrant’s participation in this Promotion; or (ii) the receipt or use of the prizes (including but not limited to the substitution or changing of any prizes) awarded in this Promotion.
