RULES AND PROCEDURES GOVERNING THE 2022 HOOSIER LOTTERY JUMBO CASH HAPPY HOUR PROMOTION AT THE INDIANA STATE FAIR

The State Lottery Commission of Indiana (“Hoosier Lottery” or “Lottery”), hereby promulgates these rules and procedures (“Official Rules”) governing the 2022 JUMBO CASH Happy Hour Promotion (“Promotion”) at the Indiana State Fair (“Fair”) in accordance with 65 IAC 1-7-4.

A. PURPOSE

The Promotion will be held to generate awareness of the Hoosier Lottery’s player program (myLOTTERY) and encourage players to be active myLOTTERY members and active users of the Hoosier Lottery app.

B. PROMOTION PERIOD & DRAWING DATE

  1. The Promotional Period will begin at 5:00 p.m. ET on Friday, July 29, 2022 and will end on or about 6:00 p.m. on Saturday, August 20, 2022. The Fair is closed on Mondays and Tuesdays, so there will be a total of 17 Happy Hours conducted.
  2. All official drawings will be conducted daily during the Promotional Period between 5:00 p.m. and approximately 6:00 p.m. at Hoosier Lottery Town located at the Indiana State Fairgrounds, 1202 E. 38th Street, Indianapolis, IN, 46205 under the Hoosier Lottery Grandstand.
  3. During the daily Happy Hour promotional window, drawings will occur every 10 minutes until a prize participant meeting the required criteria is selected. Each Happy Hour will have six (6) participants and six (6) winners.
    1. 5:10 p.m.
    2. 5:20 p.m.
    3. 5:30 p.m.
    4. 5:40 p.m.
    5. 5:50 p.m.
    6. 6:00 p.m.
  4. Over the course of the 17 Happy Hours held during the Promotion, there will be a total of 102 possible winners.
  5. All times in these Official Rules are Eastern Daylight Time.


C. DRAWINGS & PRIZE DESCRIPTIONS

  1. Drawings will be conducted by the Lottery in accordance with all applicable statutes, regulations, rules and procedures and will occur on or about the following dates and times for the listed prizes:

One hundred two (102) total over seventeen (17) days
Each day, the six (6) winners, in order of selection, will select and scratch off a prize box on the JUMBO CASH Happy Hour Game Board. There are twelve (12) prize boxes with cash prizes ranging from $100 to $500.
Here is the prize breakout for each daily Game Board:
* $500 -- 4 prizes available
* $400 -- 2 prizes available
* $300 -- 2 prizes available
* $200 -- 2 prizes available
* $100 -- 2 prizes available
Once all cash prizes at a prize value have been selected, no additional prizes at that level will be available for future winners that day.
 
  1. Prize Allocation:
    1. Each of the six (6) winners selected in the daily drawing will have an opportunity to select one (1) of twelve (12) prize boxes from the “JUMBO CASH Happy Hour” Game Board.
    2. The Game Board is new each day.
    3. Each prize slot will contain a cash prize value consistent with the table above.


D. ELIGIBILITY

  1. This Promotion is open to individuals eighteen (18) years of age or older.
  2. State Lottery Commission of Indiana members, employees, and officers, and any relative(s) (spouse, parents, siblings, and children) or person(s) residing in the same household of such member, employee, or officer are not eligible to participate in this Promotion. This restriction applies mutatis mutandis to the Lottery’s Integrated Services Provider, IGT Indiana, LLC (“IGT”).
  3. Members, directors, officers, or employees of a major procurement vendor of the Lottery, IGT, and any relative(s) (spouse, parents, siblings, and children) or person(s) residing in the same household of such persons are not eligible to participate in this Promotion.
  4. Purchase is required.

E. HOW TO PARTICIPATE
  1. To enter, a participant must attend the Fair and visit the Hoosier Lottery Town booth located under the Hoosier Lottery Grandstand during the Promotional Period.
  2. Participants can enter by validly purchasing ten dollars ($10) in Lottery products on designated drawing days between 5:00 p.m. – 5:55 p.m. from a Lottery representative. Vending machine purchases are ineligible for entry. Specific purchase requirements vary by date:
    1. Friday, July 29, 2022 to Sunday, July 31, 2022 – Participants must purchase ten dollars ($10) in any combination of $5 and $10 Scratch-offs between 5:00 p.m.-5:55 p.m.
    2. Wednesday, August 3, 2022 to Saturday, August 20, 2022 – Participants must purchase ten dollars ($10) in any combination of JUMBO CASH Scratch-offs between 5:00 p.m.-5:55 p.m.
  3. Players will receive one (1) Happy Hour raffle entry ticket for each ten dollars ($10) in Lottery products the player purchases. Players may enter multiple times.
  4. Each Happy Hour raffle entry ticket will have a unique numbered two (2) part entry with a corresponding number on each portion. The player will keep the player side of the ticket for validation purposes.
  5. The player must place the entry portion into the designated drawing device(s).  Each Happy Hour raffle ticket is counted as one (1) entry in a daily drawing. All entries must be deposited into the designated Happy Hour drawing device(s) in Hoosier Lottery Town at the Fair.
  6. Winners will receive one (1) selection from the then-available prize slots on the JUMBO CASH Happy Hour Game Board.
  7. If a winner does not want to personally make the selection, the winner may designate a proxy. Proxies must be at least eighteen (18) years old.
  8. Once an entry is drawn, it will not be placed back in the drawing device.
  9. All raffle entry tickets deposited in the designated Happy Hour drawing device(s) shall become the property of the Lottery. Other forms of entry other than the Happy Hour raffle entry ticket are ineligible for the drawing and will be disqualified and destroyed.
  10. Unselected raffle entry tickets during a drawing day will be discarded according to Section H of these Official Rules and will not be eligible during subsequent drawing days.

F. ODDS OF WINNING
The odds of being selected as a winner of this Promotion are dependent upon the total number of entries in the Happy Hour drawing device(s).


G. WINNER NOTIFICATION AND CLAIMING OF PRIZE
  1. All winning entry numbers will be announced via audio system to the assembled spectators, if any.
  2. Winners must be present to win and will have one (1) minute to present the player portion of the Happy Hour raffle entry ticket and a valid ID for confirmation of age and to verify no previous board selections or wins.
  3. If winner does not present the player portion of the winning raffle entry ticket in the time allotted, the entry will be disqualified, and another raffle entry ticket will be drawn.
    1. The winner of the second selected entry will have one (1) minute to present the player portion of the winning raffle entry ticket.
    2. If the winner of the second selected entry does not present the player side of the winning raffle entry ticket at the designated presentation area within one (1) minute after announcement of the winning number, the entry will again be disqualified, and another raffle entry ticket will be selected from the drawing device. This process will continue until a winner presents a valid player side of the selected raffle entry ticket or until the time arrives for the next scheduled drawing to occur.
    3. If no winner presents a valid player side of the selected raffle entry ticket by the time of the next scheduled drawing, the prize shall be forfeited, and the next scheduled drawing will be conducted.
  4. Upon timely presentation of winner information, the entry will be validated, and eligibility will be verified as in Section D (“Eligibility”).
  5. Once Winner Verification and Winner Authorization are complete, the prize will be provided to the winner on-site at Hoosier Lottery Town.
  6. Prizes awarded during the Promotion are not transferable or assignable.
  7. Only one (1) prize per raffle entry ticket. If a raffle entry ticket is selected, but not claimed, the entry will be disqualified and not placed back into the drawing device for any future drawings, if any.  
  8. An individual may only win one (1) prize during the entirety of the Promotion. If a person who claims to be a winner has already won a prize during the Promotion, the claim will be treated as ineligible and the Lottery will follow the process in item 3 under this Section G of these Official Rules, if time allows. The Lottery Security team is maintaining an official log of all winners.
  9. Winner may have to complete the necessary paperwork to claim prize.
  10. A winner may be required to participate in publicity and marketing efforts. Examples include, but are not limited to, an interview with Lottery individuals, television, radio and/or newspaper reporters and/or photographers/videographers. This information may be used in future media, the Lottery’s website, in store POP, or other marketing efforts without additional consent or compensation to the winner.

H. DRAWING PROCEDURE AND WIN ELIGIBILITY
  1. The rules and procedures set forth in these Official Rules shall govern this Promotion. These rules may be amended at any time by the Hoosier Lottery without advance notice.
  2. The Lottery’s Executive Director or her designee may, at any time, announce a suspension or termination of the Promotion, without advance notice and in the Executive Director’s sole discretion, at which point no Prize shall be awarded. The Lottery, the Executive Director, IGT, nor any employee thereof, shall have any liability whatsoever for any such termination.
  3. By participating in the Promotion each participant agrees to comply with and abide by Indiana law, rules, and regulations as well as the terms and conditions of the Lottery website and all final decisions, policies, or procedures of the Lottery in relation to the conduct of this Promotion. Any dispute arising which relates to any aspect of this Promotion shall be governed by the laws of Indiana.
  4. In the event of a dispute arising out of these Official Rules, the participant’s remedy is limited to entry in another promotion with prizes of a similar value.
  5. The Lottery, IGT, and their agents are not responsible for error, omission, interruption, deletion, defect, delay in operations, theft or destruction, unauthorized access to or alterations of Promotion, failure to receive claim, winner, or other Promotion information for any reason whatsoever.
  6. The Hoosier Lottery is not responsible for issues with account accessibility or Promotion entries due to technical problems associated to software, hardware compatibility or internet access.
  7. By entering this Promotion, each participant agrees to follow these Official Rules and forever releases, discharges, and waives any and all claims, liabilities and actions of any kind, howsoever caused or arising and whether by negligence, any intentional act or otherwise, that entrant may have or that may arise against the Hoosier Lottery, IGT, and each of their respective parents, subsidiaries, affiliates, and related entities, as well as each of the aforementioned parties’ respective associates, directors, officers, owners, shareholders, partners, members, employees, agents, representatives, successors and assigns (collectively, the “Released Parties”), with respect to or arising directly or indirectly, out of, or in any way connected with, (i) entrant’s participation in this Promotion; or (ii) the receipt or use of the prizes (including but not limited to the substitution or changing of any prizes) awarded in this Promotion.  By entering, each participant further agrees to defend, indemnify and hold harmless the Released Parties and their insurers against any and all damages, costs, judgments, and/or expenses (including but not limited to attorneys’ fees and/or other legal fees) they may incur as a result of claims made against them in connection with either (i) participant’s participation in this Promotion; or (ii) the receipt or use of the prizes (including but not limited to the substitution or changing of any prizes) awarded in this Promotion. 

I. DRAWING PROCEDURE AND WIN ELIGIBILITY

  1. The rules and procedures set forth in these Official Rules shall govern this Promotion. These rules may be amended at any time by the Lottery without advance notice. 
  2. The Lottery’s Executive Director or her designee may, at any time, announce a suspension or termination of the Promotion, without advance notice and in the Executive Director’s sole discretion, at which point no prize shall be awarded. None of the Lottery, the Executive Director, IGT, or any employee of the Lottery or IGT, shall not be liable for any such termination.
  3. In the case of inclement weather or other cause, the Promotion may be suspended or terminated without advance notice at the Drawing Manager’s discretion. None of the Drawing Manager, the Lottery, IGT, or any employee of the Lottery or IGT, shall not be liable for the delay or termination.
  4. By participating in the Promotion each person agrees to comply with and abide by Indiana law, rules, and regulations as well as the terms and conditions of the Lottery website and all final decisions, policies, or procedures of the Lottery in relation to the conduct of this Promotion. Disputes related to this Promotion shall be governed by the laws of Indiana. 
  5. The Hoosier Lottery, IGT, and their agents are not responsible for error, omission, interruption, deletion, defect, delay in operations, theft or destruction, unauthorized access to or alterations of the Promotion, failure to receive claim, winner, or other Promotion information for any reason whatsoever.
  6. By participating in the Promotion, all participants agree to indemnify, hold harmless, and waive any claims against the Lottery, IGT, or any of their affiliates, associates, directors, officers, agents, representatives and assigns arising directly or indirectly, out of, or in any way connected with, this Promotion or the prize awarded in connection therewith. 

J. SPONSOR AND ADMINISTRATOR

This Promotion is sponsored and administered by IGT Indiana, LLC on behalf of the State Lottery Commission of Indiana, 1302 N. Meridian Street, Indianapolis, Indiana 46202.
